General provisions

1. These Rules (hereinafter referred to as the "Rules") are an integral part of the short-term apartment rental in Palanga and Nida service contract (hereinafter referred to as the "Contract"), which is concluded between the Renter and the Lessor on the basis of a reservation made by the Renter on the Renter's websites www.palangavisit.lt or www.visitnida.com (hereinafter referred to as the "Website"), by telephone, by e-mail or by any other communication channels.

2. Concepts:

- Reservation - a short-term rental service provided via www.palangavisit.lt or www.visitnida.com, which is managed and administered by UAB Naspecto, registered at Totorių g. 5-19, LT-01121 Vilnius, business address Kastyčio g. 3A, Palanga, contact e-mail address info@palangavisit.lt, phone number +37063008558, which provides and administers the rental of apartments in accordance with the present Rules.

- The Lessor - UAB Naspecto, registered address Totorių g. 5-19, LT-01121 Vilnius, business address Kastyčio g. 3A, Palanga, contact e-mail address info@palangavisit.lt, tel. no. +37063008558.

- Renter means a person or legal entity renting apartments or purchasing other services from the Landlord through the websites www.palangavisit.lt or www.visitnida.com. Only persons of legal age and legal entities acting through authorised representatives may be a Renter.

- Booking Confirmation - confirmation of a booking made by the Renter via the Website.

- Check-in - The process of the tenant arriving at the apartment, receiving the keys and starting the rental period.

- Check-out - the process of the Tenant leaving the apartment and returning the keys to the Landlord.

3. The Contract shall be deemed to have been concluded when the Renter makes a reservation, selects the method of payment, provides the required data and receives the Renter's confirmation of reservation. The Contract shall remain in force until the end of the rental period or its termination in accordance with the terms and conditions set out in these Terms and Conditions or in the applicable legislation.

4. The Rules are a binding document setting out the rights and obligations of the Tenant and the Landlord, the booking, payment, check-in, check-out and other provisions related to the rental of apartments through the Website.

5. The Lessor shall have the right to amend or supplement the Rules at any time. Registered Tenants will be notified of any changes and will be required to accept the new Terms and Conditions in order to continue using the Services. Changes to the Terms and Conditions will only apply to bookings made after the change.

6. These Terms and Conditions apply from the date of their submission and supersede all previous rules applicable to bookings on the Website.

7. Reservations are only accepted at the locations indicated on the Website.

8. By making a reservation, the Renter confirms that he/she has read, understood and agrees to the Terms and Conditions (by ticking the box next to the statement "I have read and agree to the Terms and Conditions").

9. The Lessor shall send all notifications to the Lessee via the email address provided at the time of registration or booking. The Renter shall contact the Lessor using the contact details provided on the Website.

10. The Lessor has the right to restrict or terminate the Lessee's access to the Website services if the Lessee violates these Terms or attempts to undermine the stability and security of the Website.

11. In the event of force majeure, the Lessor shall have the right to suspend the performance of the Contract until the circumstances are over by informing the Lessee thereof. If the Lessee is no longer interested in the subsequent performance of the Contract, the Lessee shall have the right to withdraw from the Contract by notifying the Lessor.

12. The Lessor may temporarily suspend or discontinue the operation of the Website by publicly announcing this on the Website. Reservations made prior to the suspension or termination will be fulfilled in accordance with these Terms.

Tenant registration and data protection

13. The renter can use the website and make reservations as:

- Registered Tenant: By creating an account using your email, mobile phone number and password. Additional information may be required, e.g. name, contact details.

- Guest Tenant: By providing the necessary details at the time of booking without creating an account.

14. The Lessee is responsible for the accuracy and completeness of the information provided. In the event of a change in the data, the Lessee shall update it immediately. The Lessor shall not be liable for damages resulting from inaccurate or not updated information.

15. The Tenant may choose to receive notifications and offers from the Landlord. He can change the settings in his account or by contacting the Landlord.

16. Mandatory notifications about Reservations, provision of Purchased Services and account registration will be sent irrespective of the Lessee's settings or preferences.

17. The Lessor has the right to collect and process the data provided by the Lessee for the purposes of reservations, data processing and analysis. The data may be used for marketing purposes with the consent of the Renter or in accordance with the laws and regulations of the Republic of Lithuania. 18. The Renter may change, amend or delete his/her registration details at any time.

Tenant rights

19. The Renter has the right to rent the apartment in accordance with these Terms and Conditions and the applicable conditions of sale at the time of booking.

20. The Renter has the right to withdraw from the Contract as provided for in the Apartment Rules, which can be found here: https://palangavisit.lt/apartamentu-taisykles/

21. The Lessee must notify the Lessor of the cancellation by submitting a duly completed cancellation form or a clear statement to the contacts provided.

22. The tenant must return the keys and vacate the apartment by the agreed date. The tenant is liable for any damage or loss caused during the rental period.

23. Refunds for cancelled bookings will be made within 14 days of the cancellation notice, provided that no damage has been caused to the apartment by the Renter and that the cancellation conditions, which can be found here: https://palangavisit.lt/apartamentu-taisykles/, have been met

Lessee's obligations

24. The Renter is obliged to comply with these Rules and the legislation of the Republic of Lithuania when using the Website and the rented apartments.

25. The Renter is obliged to pay the agreed amount for the rental period and any additional services ordered as per the payment rules https://palangavisit.lt/apartamentu-taisykles/

26. The Tenant must update the registration details if they change.

27. The Renter shall not disclose his/her account or the Reservation Data to any third party.

28. If the Renter violates these Rules, the Landlord shall have the right to terminate the Agreement and demand that the Renter immediately move out of the rented apartment.

Making a reservation

29. The Landlord may cancel the Reservation if the Renter does not pay within 24 hours of the confirmation of the Reservation. Upon payment of a cancelled Booking, the Hirer shall be refunded the full amount paid less any direct losses incurred by the Landlord in collecting and administering the payment.

30. The Lessor shall charge a service fee for the execution of the Reservation as stated on the Website.

31. The Renter must arrive and leave at the agreed time. Early check-in or late check-out may incur additional charges as provided in the apartment rules https://palangavisit.lt/apartamentu-taisykles/

32. If the apartment becomes unavailable due to unforeseen circumstances, the Landlord will offer a similar or better alternative. If the Renter is not satisfied with the alternative, the Renter may cancel the Reservation and receive a full refund.

33. The Tenant is obliged to check the apartment on arrival and report any problems immediately.

Prices, payment procedure and terms

34. Prices are quoted in euros (EUR) and include all applicable taxes and charges. The submission of the price at the time of the Booking is mandatory. Bank charges may apply depending on the bank used by the Buyer.

35. The Renter is obliged to pay for the Reservation and the additional services ordered prior to the arrival date using the payment methods indicated on the Website.

Final provisions

36. These Rules shall be governed by the legislation of the Republic of Lithuania.

37. In the event of damage, the party at fault shall indemnify the injured party for reasonable losses in accordance with the procedures and on the grounds established by the laws of the Republic of Lithuania.

38. Any disputes arising out of these Terms and Conditions will be settled by negotiation. In the event of failure to reach an agreement, disputes shall be settled in accordance with the law of the Republic of Lithuania.

39. Lessees may resolve disputes with the Lessor through the State Consumer Rights Protection Service (Vilnius, Vilniaus g. 25, e-mail: tarnyba@vvtat.lt, phone: 852626751, website: www.vvtat.lt) or the European Commission's Electronic Consumer Dispute Resolution Platform (http://ec.europa.eu/odr).
